Intellectual Property Statement

1. Purpose and Scope

This Intellectual Property Statement explains how intellectual property associated with SimpleHouseLiving and simplehouseliving.com may be used and how concerns about possible infringement may be reported.

This Statement applies to the SimpleHouseLiving website, online store, product pages, marketing materials, and other content made available by or on behalf of SimpleHouseLiving. It supplements our Terms of Service. If this Statement conflicts with the Terms of Service regarding user-submitted content or use of the website, the Terms of Service will control to the extent of the conflict.

Nothing in this Statement limits any use, exception, defense, or right available under applicable law.

2. SimpleHouseLiving Content and Brand Materials

Unless otherwise stated, the content and materials displayed on or made available through simplehouseliving.com are owned by, licensed to, or used with permission by SimpleHouseLiving or the relevant rights holder.

These materials may include:

  • The SimpleHouseLiving name and logo;

  • Brand identifiers, slogans, visual identity elements, color treatments, and graphic assets;

  • Website layout, page design, navigation, and the selection and arrangement of content;

  • Product photographs, lifestyle images, illustrations, icons, graphics, and artwork;

  • Videos, animations, audio, and other audiovisual materials;

  • Advertising creatives, campaign materials, banners, and promotional content;

  • Product titles, descriptions, specifications, instructions, editorial copy, and other written content; and

  • Downloadable materials and other original content presented through the website.

Individual elements may be protected by copyright, trademark, trade dress, contract, or other applicable laws. Some website technology, theme components, fonts, applications, stock assets, product materials, and other elements may belong to third parties and are used under applicable licenses or permissions.

References to SimpleHouseLiving as a trademark or brand identifier do not state or imply that the name or logo is federally registered.

3. Limited Personal, Non-Commercial Use

SimpleHouseLiving grants you a limited, revocable, non-exclusive, non-transferable permission to access and view the website and to download or print a reasonable number of pages solely for your personal, non-commercial use.

This permission is subject to the following conditions:

  • You must not modify the materials;

  • You must retain all copyright, trademark, attribution, and other proprietary notices;

  • You must not use the materials to suggest sponsorship, approval, affiliation, or endorsement by SimpleHouseLiving; and

  • Your use must comply with our Terms of Service and applicable law.

No ownership interest or broader license is transferred to you. Any use beyond this limited permission requires prior written authorization from SimpleHouseLiving or the applicable rights holder, unless the use is independently permitted by law.

4. Prohibited Uses

Except with prior written permission or where applicable law expressly permits the activity, you must not:

  • Copy, reproduce, modify, adapt, translate, distribute, sell, license, publicly display, publicly perform, republish, upload, transmit, or create derivative works from protected SimpleHouseLiving materials;

  • Extract, scrape, crawl, harvest, download in bulk, or systematically collect website content, product data, images, descriptions, prices, reviews, or other materials;

  • Repost, syndicate, mirror, frame, or embed substantial portions of the website or its content on another website, service, catalog, marketplace, or database;

  • Use the SimpleHouseLiving name, logo, visual identity, page design, advertising materials, product content, or confusingly similar materials to impersonate SimpleHouseLiving or create a false impression of affiliation, sponsorship, approval, or origin;

  • Register or use a domain name, social-media identifier, seller name, advertising keyword, or other identifier in a manner likely to confuse consumers about its connection with SimpleHouseLiving;

  • Remove, obscure, alter, or bypass a copyright notice, trademark notice, attribution, watermark, rights-management information, access control, or other proprietary designation;

  • Use protected materials to create counterfeit listings, misleading advertisements, unauthorized storefronts, or deceptive product offers; or

  • Assist another person in doing any of the foregoing.

Reasonable use by standard search engines, accessibility tools, and security or research activity authorized by SimpleHouseLiving is not prohibited solely by this section. This Statement also does not restrict fair use, nominative use, commentary, criticism, news reporting, or another use protected by applicable law.

5. Third-Party Trademarks and Materials

Third-party names, logos, product images, product packaging, service marks, payment marks, platform marks, fonts, applications, and other materials appearing on the website remain the property of their respective owners.

Their appearance does not imply that SimpleHouseLiving owns those rights or that the third party sponsors or endorses SimpleHouseLiving, except where an authorized relationship is expressly stated.

Use of a third party’s material is governed by the applicable owner’s terms, license, and legal rights. If you wish to use third-party material, you should seek permission from the relevant rights holder rather than from SimpleHouseLiving.

6. User-Submitted Content

Users retain ownership of intellectual property rights they hold in reviews, photographs, comments, suggestions, and other content they submit.

As stated in our Terms of Service, by submitting content to SimpleHouseLiving, a user grants SimpleHouseLiving a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content solely for operating, improving, and promoting SimpleHouseLiving and its products or services, subject to applicable law and our Privacy Policy.

This license does not transfer ownership of user content to SimpleHouseLiving and does not prevent the user from using that content elsewhere.

Users must own the content they submit or have the necessary permission to submit it. SimpleHouseLiving may moderate or remove content when reasonably necessary to address an apparent violation of intellectual property rights, our Terms of Service, or applicable law.

SimpleHouseLiving will not prohibit, penalize, or claim ownership of an honest consumer review merely because it is critical or unfavorable.

7. Reporting a Good-Faith Intellectual Property Concern

If you believe content on simplehouseliving.com infringes intellectual property rights that you own or are authorized to enforce, email a written complaint to contact@simplehouseliving.com.

To help us locate and evaluate the material, include:

  1. Your full name and, if applicable, the name of the rights holder you represent;

  2. A brief explanation of your authority to act for the rights holder, if you are submitting the complaint on someone else’s behalf;

  3. A clear description of the copyrighted work, trademark, trade dress, or other right claimed, together with relevant supporting information;

  4. The specific URL of each SimpleHouseLiving page containing the material at issue and a description of where the material appears;

  5. Your email address and another reasonable means of contact, if available;

  6. A statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or applicable law;

  7. A statement that the information in your complaint is accurate and that you are the rights holder or are authorized to act on the rights holder’s behalf; and

  8. Your physical or electronic signature.

Please provide only information reasonably needed to evaluate the complaint. Do not send government identification, complete financial information, account passwords, or other unnecessary sensitive personal information unless we specifically request information and there is a lawful reason to provide it.

Providing complete and accurate information helps us review a complaint efficiently. A submission under this section is a general intellectual property complaint and is not represented as a formal notice under the Digital Millennium Copyright Act or any other statutory notice-and-counter-notice procedure.

8. Review and Response

We may acknowledge a complaint, request reasonably necessary clarification or documentation, review the identified material, and contact the person who supplied or posted the material where appropriate.

Depending on the circumstances and to the extent permitted by applicable law, we may remove or restrict access to material, correct an attribution, seek proof of authorization, restore material when a complaint is unsupported, or take another reasonable step.

Submitting a complaint does not guarantee removal, and SimpleHouseLiving does not adjudicate ownership disputes. Complex disputes may need to be resolved directly between the parties or through appropriate legal processes.

Information in a complaint may be shared with the person responsible for the disputed material, our service providers, Shopify, professional advisers, or authorities when reasonably necessary to evaluate or respond to the complaint or when required by law. Please consider this before submitting personal information.

9. Repeat or Egregious Infringement and Misuse of the Process

SimpleHouseLiving may restrict submissions, suspend relevant website privileges, remove content, or take other proportionate action when a user repeatedly or knowingly submits infringing material, or when an infringement is willful or egregious, subject to the Terms of Service and applicable law.

We may reject or close complaints that are materially incomplete, fraudulent, abusive, duplicative, or submitted in bad faith. We may also take proportionate action against misuse of the complaint process to the extent permitted by applicable law.

Do not knowingly make false claims or materially misrepresent ownership, authorization, or infringement. A mistaken claim made in good faith will not, by itself, be treated as malicious.

10. No Waiver; Disclaimer

SimpleHouseLiving's decision to review, remove, retain, or restore material does not constitute an admission of infringement, ownership, liability, or waiver of any right or defense.

This Statement provides general information about SimpleHouseLiving practices. It is not legal advice and does not create a promise that every intellectual property dispute will be resolved in a particular manner or within a particular period.

To the fullest extent permitted by applicable law, SimpleHouseLiving reserves all rights and remedies relating to its content, brand identifiers, and other intellectual property. Nothing in this Statement expands SimpleHouseLiving's rights beyond those provided by applicable law, applicable licenses, or valid agreements.

11. Applicable Law and Other Rights

Intellectual property rights and permitted uses vary by jurisdiction. This Statement applies subject to applicable copyright, trademark, unfair-competition, consumer-protection, and other laws.

Nothing in this Statement limits rights or remedies that cannot lawfully be excluded, waived, or restricted. Nothing in this Statement prevents a person from contacting Shopify, a relevant platform, a court, a government authority, or another appropriate body regarding an intellectual property concern.
